All about CBD
CBD short form of cannabidiol, is a cannabinoid derived from the hemp plant. It is believed that it has strong healing effects due to its medicinal properties. Is CBD legal in the UK?
If a substance is intoxicating, it is put on the controlled substance list. However, in the UK, USA and EU, Cannabidiol is not mentioned in this list. Instead, THC is the cannabinoid that is on this list, making it illegal. THC is responsible for creating euphoria in users, but its amount is very low in the hemp plant compared to marijuana. That’s why the hemp plant is the legal source to extract CBD.
In the UK, hemp products for non-Industrial use must not contain traceable THC and CBN. In other words, both intoxicating cannabinoids should not be detectable in CBD products. Under the Drug Abuse Act 1971, THC and CBN are listed in the controlled substances list.
While the UK only allows retailers to sell products with undetectable CBN and THC, the EU allows 0.2 percent THC. Similarly, in the United States, CBD products that contain less than 0.3 % are considered legal.
Is CBD flower legal in the UK?
In the UK, MoDA makes no difference between different species of Cannabis, such as a high THC containing marijuana and low THC containing hemp plant. Since the harvesting of CBD flowers is not legal under MoDA, its possession is considered illegal. Except for the fiber, stalk, and seed of the mature plant, all the other parts are considered as a class B drug. However, the law permits the possession of CBD products derived from the hemp plant.
Laws regarding hemp
It is not legal to grow any Cannabis plant (hemp or marijuana) in the United Kingdom. If a person wishes to grow hemp or Cannabis, he needs a license from the UK home office. But this permit does not allow the extraction of CBD from hemp flowers that are a rich source of required cannabinoids. So there is no legal possibility to extract CBD from the hemp plant in the UK.
What about CBD oil as a food supplement?
In the United Kingdom, mostly CBD oil is being marketed as a food supplement but under certain conditions. CBD oil food supplements cannot claim to diagnose, cure or prevent any disease. Moreover, under the UK medical Cannabis program, people can access private prescription CBD products from a doctor, but they are very hard to obtain and expensive.
The United Kingdom CBD industry is not well regulated, unlike medical Cannabis. Resultantly products may contain a high dose of THC or very little CBD content compared to what is mentioned on the label.
